Terms of Service
These Terms of Service (“Terms”) govern your access to and use of The Keyboard Cup website and related services (the “Service”) operated on behalf of Holland Township School (“we,” “us,” or “School”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service provides typing practice, speed tests, leaderboards, and related educational features. Features may change, be suspended, or be discontinued at any time without notice, except where required by law.
2. Eligibility and accounts
Where sign-in is offered, it may be limited to accounts authorized by the School (for example, specific Google Workspace domains). You must provide accurate information and keep your credentials secure. You are responsible for activity that occurs under your account.
3. Acceptable use
You agree not to:
- Use the Service in any way that violates applicable law or school policy;
- Attempt to gain unauthorized access to systems, data, or accounts;
- Interfere with or disrupt the Service, including by automated scraping or excessive load, except as expressly permitted;
- Harass, abuse, or harm others, or submit offensive or unlawful content through any user-provided fields;
- Reverse engineer or attempt to extract source code except to the extent permitted by law.
4. User content and scores
Performance data (such as typing scores and leaderboard entries) may be stored and displayed as part of the Service. You grant the School a non-exclusive license to use, store, and display such information for operating the Service and educational purposes consistent with our Privacy Policy.
5. Third-party services
The Service may integrate third-party services (for example, Google Sign-In). Your use of those services is subject to the third party’s terms and privacy policy. We are not responsible for third-party services.
6. Intellectual property
The Service, including its design, text, graphics, and software, is owned by the School or its licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial educational use in accordance with these Terms.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SCHOOL AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY), OR (B) ZERO DOLLARS, IF THE SERVICE IS PROVIDED WITHOUT CHARGE.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum permitted by law.
9. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless the School from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of these Terms.
10. Termination
We may suspend or terminate access to the Service at any time, with or without cause or notice. Provisions of these Terms that by their nature should survive will survive termination.
11. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles, except where preempted by applicable federal law. Courts in New Jersey shall have exclusive jurisdiction over disputes, subject to mandatory provisions of your local law where they cannot be waived.
12. Changes
We may modify these Terms at any time. We will update the “Last updated” date when we do. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.
